Trade Secrets
Trade secret protection is similar to trademarks in that it can theoretically last forever. The reason trade secrets are offered as a mean of protection is because some intellectual property is best kept a secret. With all other forms of IP the idea must be publicly disclosed or distributed. Many clients find it difficult to enforce a patented method, so instead they keep their method a secret. The catch is that there has to be steps to taken to keep the method, recipe, etc. a secret. However, if the secret is discovered and disclosed to the public then the protection is lost. This is often a popular option for recipes or formulas to your “secret sauce” if you will. One of the most famous trade secrets is the formula to make Coca-Cola’s cola. |
